TERMS AND CONDITIONS User Agreement Our goal at Green Kids Auction (aka GKA) is to make things as simple and clear as possible. This document outlines the Terms and Conditions for Users of the Green Kids Auction site. We have tried to write this agreement in terms that are easily understandable. Fees and Services By using the Green Kids Auction site (aka GKA), you accept and agree our terms and conditions of use. If you do not agree with these terms, then please do not use the site. GKA is an interactive On-line Auction Venue. We publish items that are submitted by sellers. GKA is not involved in the actual transaction between buyers and sellers. Although we have very high standards and count on our community members to respect these standards, we cannot control the safety, quality or legality of the items advertised. We assume that our members list their items in good faith and accuracy. In order to confirm the safety of items, we encourage buyers to visit the Consumer Product Safety Commission website at:http://www.cpsc.gov/ before making any purchases. Since GKA does not own any of the items listed, we cannot be held liable for any loss or damage including indirect or consequential loss or damage which results from using the GKA site. We cannot be responsible that transactions are completed between buyers and sellers. Individuals are able to utilize our auction website after registration. GKA has the right to deny registered users access to the site at any time. Fees
Our goal at Green Kids Auction is to create a win-win-win relationship for all parties involved. Bottom line, we want to save you money while making a positive difference for the planet our children will grow up on. To make it risk-free for you to try out site, we allow you to list your goods for FREE. If you choose to add an upgrade to your listing, please see the nominal fees below. Should you choose to do a standard free listing, you will only pay a fee if and when your items sell. This is called a "success fee". The fee charged depends on the final sale price of your goods.
All of these fees are billed based on the following terms: 1. Once Your Account reaches $15 or more or 2. On the 15th of each Month

If your account is not settled within 7 days your access to the site will be restricted. Bidding is always free on GKA In order to sell an item, you must register and accept the terms and conditions of Green Kids Auction and the above fee schedule. We reserve the right to change our fees at any time, and will notify you via email with any corresponding changes to the fee structure. Unless otherwise stated all fees will be in U.S. currency. 2. Bidding and Buying The User agrees to comply with all the terms and conditions herein. The right to use Green Kids Auction (aka GKA) is agreeable by the User and not transferable. Registration and Bidding is free on GKA however you must register before you are able to Bid on or Sell items. As a Seller, you are obligated to sell the item to the winning Bidder for the price as stated at the end of the Auction. As a Buyer, you are committed to buy the item from the Seller at the price stated at the end of the Auction.(if you are the winning Bidder) To increase the price that your pre-loved goods could sell for, always where possible include any original packaging, tags, instructions, warranties or warnings. 3. Listings The "free until sold" policy is available to all members of GKA. If upgrades are chosen such as the options detailed in Fees 1.2 then the chosen fees will be applied to your account before the item is sold. Because of the "free until sold" we request that no other websites or URLS, email addresses or phone numbers be contained within your listing. Listings need to have accurate prices. A greatly reduced price or "free" on your item in an attempt to gather leads is not permitted. These listings will be removed. 4. Confidentiality As a User, you are responsible for the confidentiality of your User names and Passwords. As a user, you are responsible for any activity in your account. Any suspected fraudulent activity must be reported immediately to: support@greenkidsauction.com. 5. Privacy Policy Privacy Policy StatementThis is the website of www.greenkidsauction.com. If you do not wish to receive email from us in the future, please let us know by sending us an email at: remove@greenkidsauction.com When we have got a really exciting event happening in your area, we may send you a flyer or announcement to invite you to participate. If you do not wish to receive such mailings, please let us know by sending an email to: remove@greenkidsauction.com Please provide us with your exact name and address. We will make sure that it is removed from our list. If our information practices change at any time in the future we will send you an email, post the Policy changes to our website to notify you of these changes, and provide you with the ability to opt out of these new uses. Integrity of our word is of primary importance to us. If at any time you feel that our site is not following its stated information policy, please contact us at the above address. 6. Intellectual Property All intellectual Property including Trademarks, Logos and Domains are the exclusive rights to Green Kids Auction. You do not have the right to reproduce, distribute or transform any of the intellectual Property without written permission from GKA. 7. Permitted Uses As a user, you must use the site for lawful purposes only. Users will not post any items or material which infringes in any way the rights of others or invade another's privacy. By becoming a registered user, you agree not to breach any rules of use of the Internet or laws applicable to the country in which you reside. Users shall not use GKA to advertise any commercial solicitation including but not limited to, the solicitation of Users to become subscribers of other on-line informational services competitive with GKA. Users shall not upload or post any material protected by copyright or trademark without the permission of the owner of the copyright. Any material submitted to GKA by the User automatically grants GKA the non exclusive rights to use and publish the image and information. The User also permits other Users to access, view, and store or reproduce the material for the Users personal use. 8. Disclaimer The User agrees that the use of Green Kids Auction is entirely at the Users sole risk. We are completely committed to keeping our site up and running at all times, but neither GKA, its affiliates nor any of their respective employees, agents, 3rd party providers can guarantee that GKA will be uninterrupted or free of errors. Every precaution will be taken to avoid such action. If you experience any technical errors, please notify us immediately at: support@greenkidsauction.com. GKA does not make claims to the success, reliability or content of any listing. We cannot make any promises as to the outcome of your auction, and we cannot offer any warranties on any products sold on GKA. Since we don't own any of these products ourselves, you must take responsibility for transactions between the buyer and seller. 9. Monitoring GKA has the right, but not the obligation, to monitor the content on GKA to determine suitability, satisfy laws and terms and conditions. Please respect our fellow community members and publish items with integrity. If information is not deemed appropriate, GKA has the right to edit, refuse or remove any material posted. 10. Termination At any time GKA may terminate this agreement or a Users account due to misconduct, unacceptable behavior or any breach of any of these agreements. 11. Refund Policy GKA does not offer any refunds for listing upgrades or success fees. There are no warranties given by GKA to any product that is sold via the website. However, there may be a warranty or returns policy offered by the Seller of the goods. Please refer to each individual listing. As a user, you are responsible for your User name and Passwords. If fraudulent activity is suspected within your account, it must be reported immediately to: fraudalert@greenkidsauction.com In the case where the activity is proven to be fraudulent and unauthorized amounts have been charged to your account, a refund or credit will be issued totaling that amount. In the unlikely case of the above, the method of refund will be via the payment method you currently have on file. Before such time, please verify that all your contact information is correct by clicking on My Account. Please allow 30 days for processing. |
